2021 AGM – ‘Special Resolutions’ Explained

For those of you would could not attend, the Macleay Tower and Villas Annual General Meeting was held on 24th August 2021.

At this meeting there were a number of Motions which proposed changes to the Body Corporate By-Laws. All of these motions passed, except one related to a change in the Pet By-Law and there have been some questions about why it did not pass even though the majority of the votes lodged were in favour of the motion.

The Queensland Strata legislation stipulates that a Motion to change to any Body Corporate By-Law must be by “Special Resolution”. And in order for a special resolution to be passed at a General Meeting, a supermajority is required in favour of it. Supermajority refers to at least 2/3 of the members voting in favour of the resolution. So even though the motion received over 50%, it did not reach the required 2/3 threshold and so was not passed.
